Appeals and Tribunal Representation

Receiving an immigration or asylum refusal can be stressful, especially where your family life, protection claim, immigration status or future in the UK is at risk.

DirectWay Immigration Limited can review the refusal decision, advise on the merits of an appeal, prepare the appeal documents, gather and organise supporting evidence, and represent you before the Immigration Tribunal where appropriate.

Who is this Service for?

This service is for individuals who have received an immigration or asylum refusal decision and need advice on whether the decision can be appealed or challenged before the Immigration Tribunal.

This may include refusals involving family life, private life, human rights, asylum, humanitarian protection, refugee family reunion, EUSS matters, deprivation decisions or other immigration decisions carrying a right of appeal.

We can also assist where an appeal has already been lodged and the case needs to be prepared for hearing, where further evidence needs to be submitted, where witnesses need to be prepared, or where an unfavourable Tribunal decision needs to be reviewed for possible permission to appeal to the Upper Tribunal.

How DirectWay Can Help

DirectWay Immigration Limited can assist with immigration and asylum appeals from the initial review of the refusal decision through to preparation and representation before the Immigration Tribunal. We can assess the reasons for refusal, advise on the merits of an appeal, identify the evidence needed, and explain the appeal process clearly so that you understand the steps involved and the issues that need to be addressed.

We can draft grounds of appeal, prepare witness statements, organise the appeal bundle, draft the Appellant’s Skeleton Argument, correspond with the Tribunal and the Home Office, and help prepare clients and witnesses for the hearing. Where appropriate, we can represent you before the Immigration Tribunal and make submissions on your behalf.

We can also assist with more specific appeal-related applications, including Rule 15(2A) applications to rely on further evidence, adjournment applications, post-hearing submissions, applications for permission to appeal, and renewed applications to the Upper Tribunal. As a Level 3 regulated organisation, DirectWay Immigration Limited is authorised to conduct immigration appeal work and appear before the Immigration Tribunal within the scope of our regulation.

Common Issues We Can Assist With

Appeals often involve detailed factual, evidential and legal issues which need to be addressed carefully before the hearing. We can assist where the refusal decision contains poor reasoning, where important evidence has been overlooked, where further evidence needs to be submitted, or where the Home Office has raised concerns about credibility, relationship evidence, Article 8, asylum risk, children’s best interests, suitability, immigration history or exceptional circumstances.

We can also assist where there are procedural issues, adjournment requests, unfairness concerns, errors of law, or where a Tribunal decision needs to be reviewed for possible onward appeal.

Our Approach

At DirectWay Immigration Limited, we approach appeal work carefully and realistically. We will review the refusal decision, identify the issues in dispute, advise on the strengths and weaknesses of the case, and explain the evidence needed to support the appeal. We do not treat appeals as a simple disagreement with the Home Office. Each appeal must be prepared with a clear understanding of the refusal reasons, the relevant legal framework, the evidence available, and the submissions that need to be made before the Tribunal.

Our approach is structured, evidence-led and focused on proper preparation. We aim to ensure that witness statements, appeal bundles, skeleton arguments and oral submissions are clear, accurate and relevant to the issues the Tribunal must decide. Where there are difficulties in the case, we will address them directly and advise you realistically on the options available.
